Cell Phone Tickets

When operated a motor vehicle while using a cell phone first became a violation of law it actually did not carry any points in Southampton. Over the last 20 years New York has added points to the violation and then increased the point value twice.  Today Southampton cell phone tickets carry 5 points and are categorized as a major traffic infraction by the NYS DMV.

In Southampton, tickets for using a cell phone without a hands-free device are issued under VTL 1225.C2a.  Under the law, one of the elements of a cell phone violation is that the phone must be held to the ear or in immediate proximity of the ear. Situations that involve a cell phone or portable electronic device being held elsewhere, not in proximity of the ear, without a hands-free device, are chargeable under VTL Section 1225.D, as a portable electronic device violation.

Portable electronic device violations carry 5 points as well. Holding your cell phone in your hand while using it for GPS, viewing an email or text, or even holding a cell phone to change music are some of the more common portable electronic device violations. Some courts draw a distinction between the two different charges and will prosecute the two violations differently. The law does provide exceptions when using a cell phone to call the police, calling 911, calling fire personnel, or calling medical personal with regard to a medical emergency.

A number of courts in Suffolk County take a hard position with regard to cell phone violations, often refusing to reduce them at all. If you have been charged with a cell phone violation or portable electronic device violation in Southampton, it is not a good idea to simply plead guilty to them. They carry a lot of points and can affect your license, and increase your insurance premium.
